Terms of Service

By accessing or using ColorCraft AI ("Service"), available at https://colorcraft.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and ColorCraft AI ("Company," "we," "us," or "our"). Please read them carefully.

ColorCraft AI is an online platform that provides free and premium coloring page downloads as well as an AI-powered coloring page generator. Our AI features use the FLUX model via Replicate to create original coloring page artwork based on user-submitted text prompts or photo conversions.

To access certain features you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account credentials.
• Promptly notify us of any unauthorized access or security breach.
• Accept responsibility for all activity that occurs under your account.

You must be at least 13 years of age to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.

ColorCraft AI offers the following plans:

• Free — 3 downloads per day, 10 AI credits per month, access to standard-quality coloring pages. No payment required.
• Pro ($6.90/month) — Unlimited downloads, 200 AI credits per month, HD downloads, photo-to-coloring conversion, and commercial-use license for generated content.
• Family ($12.90/month) — All Pro features plus 500 AI credits per month and support for up to 5 family member profiles.

Annual billing is available at a discounted rate (Pro at $5.50/month, Family at $9.90/month, billed annually).

4.1 Free Trial

The Pro plan includes a 7-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan, and your payment method on file will be charged.

4.2 Payment Processing

All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate. You are responsible for keeping your payment information up to date.

4.3 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing cycle. Unused monthly credits do not roll over after cancellation.

Certain AI features consume credits from your account balance:

• Text-to-coloring-page generation: 1 credit per generation.
• Photo-to-coloring-page conversion: 5 credits per conversion (Pro and Family plans only).

Monthly plan credits are replenished at the start of each billing cycle and do not carry over to the next cycle. Purchased credit packs (50 credits for $1.90, 100 credits for $2.90, or 300 credits for $6.90) never expire and are available to all users regardless of plan. Credits have no cash value and are non-transferable between accounts.

We reserve the right to modify credit costs, credit allocations, and credit pack pricing at any time. Such changes will not apply retroactively to credits already purchased.

You agree not to use the Service to:

• Submit prompts that generate content that is violent, sexually explicit, hateful, discriminatory, or otherwise offensive or illegal.
• Generate content that infringes on the intellectual property rights of any third party, including copyrighted characters, trademarks, or logos.
• Systematically scrape, download in bulk, or redistribute collections of coloring pages from the Service without our prior written consent.
• Use automated bots, scripts, or other means to access the Service in a manner that exceeds reasonable usage or places undue load on our infrastructure.
• Attempt to reverse-engineer, decompile, or disassemble any aspect of the Service.
• Resell, sublicense, or otherwise commercially exploit your account access or credits.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to review AI-generated content and to remove any content that violates these guidelines. Repeated violations may result in account suspension or termination without refund.

7.1 Platform Content

All coloring pages, illustrations, designs, text, graphics, logos, icons, and software comprising the Service are owned by ColorCraft AI or its licensors and are protected by copyright and other intellectual property laws.

7.2 AI-Generated Content License

When you generate a coloring page using our AI tools, you receive the following license based on your plan:

• Free plan: You are granted a non-exclusive, non-transferable license to use AI-generated coloring pages for personal, non-commercial purposes only (e.g., printing at home, personal gifts).
• Pro and Family plans: You are granted a non-exclusive, royalty-free license to use AI-generated coloring pages for both personal and commercial purposes (e.g., inclusion in printed workbooks, educational materials, or products for sale).

In all cases, you may not claim that AI-generated content was created by a human artist, or misrepresent the origin of the content. You may not use AI-generated content to train other AI or machine learning models. ColorCraft AI retains the right to display, distribute, and use AI-generated content created on the platform for promotional, operational, and improvement purposes.

7.3 Downloaded Library Content

Coloring pages from our curated library (non-AI-generated) are licensed for personal use only under the Free plan. Pro and Family subscribers may use library content for commercial purposes subject to the same conditions in Section 7.2. Bulk redistribution of unmodified library content is prohibited under all plans.

7.4 User Submissions

By submitting prompts, photos, or other inputs to the Service, you grant ColorCraft AI a worldwide, non-exclusive, royalty-free license to use such inputs solely for the purpose of providing and improving the Service. You represent that you have the right to submit any content you provide.

Our AI generator is designed to produce coloring pages that are suitable for all ages. You agree to use the generator responsibly and refrain from:

• Submitting prompts intended to produce inappropriate or harmful imagery.
• Attempting to generate depictions of real persons without their consent.
• Using prompts designed to circumvent our content safety filters.

We employ automated content moderation and reserve the right to reject any prompt or remove any generated content at our sole discretion. Generated content that violates these guidelines may be deleted without notice, and credits consumed during such generation will not be refunded.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. AI-generated content may contain imperfections, artifacts, or unexpected results. We make no guarantees regarding the quality, accuracy, or suitability of AI-generated content for any particular purpose.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLORCRAFT AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

You agree to indemnify, defend, and hold harmless ColorCraft AI and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you generate or submit through the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• Any unused credits in your account will be forfeited and are not eligible for refund.
• We may delete your account data, including generated content, after a reasonable retention period.

You may also delete your account at any time from your account settings. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before new terms take effect, by posting a notice on the Service or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at legal@colorcraft.ai. We will attempt to resolve the dispute within 30 days of receiving your notice.

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ColorCraft AI regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
